What to know

When subletting a rented apartment (hyresrätt), the first-hand tenant is your contractual landlord. Distinguish this from renting a privately owned cooperative apartment or house. Start by establishing the lessor’s right to the property. Independent subletting of a rented apartment requires the property landlord’s consent or permission from the Rent Tribunal. If permission is pending when signing, make the agreement conditional on obtaining it. Cooperative apartments have a separate association-approval or tribunal route. A key or advertisement does not establish permission.

Prepare before starting

  • Write down your needs and personal budget before viewing: duration, travel, what the rent covers and additional costs. Separate these before comparing advertisements.
  • Clarify four matters privately: property type, the lessor’s identity and authority, the address and dates covered by permission, and when the agreement is made. Do not publish anyone’s documents in the group or send them to Dorehami.
  • Prepare questions about furniture, electricity, internet, insurance, keys, storage, payment arrangements and deposit repayment. This is a practical question list, not an authority’s mandatory document checklist.

A practical step-by-step approach

  1. Check the home and the lessor’s authority before paying. If someone acts as an agent, ask about their authority and verify through an independently established contact route. Time pressure is no reason to skip checks.
  2. Request a written agreement. Read the address, usable space, parties, duration, rent, extras and termination terms carefully. Get unclear clauses explained before signing; an online template does not establish suitability.
  3. For a rented apartment, the first-hand rent is a usual starting point for assessing reasonable rent; furniture and services have specific supplement rules. Do not copy this calculation to a cooperative apartment or house. Property type and contract date matter.
  4. If a deposit is agreed, record its amount, purpose, payment date, permitted deductions and settlement timing. Keep receipts privately and separate initial costs from monthly costs in your budget.
  5. Record condition, inventory and keys together at handover. Keep notes and pictures of existing defects without sharing other people’s private belongings or information. Follow up return and settlement in writing too.

Different circumstances and cautions

From 1 July 2026, Privatuthyrningslag (2026:772) governs new agreements within its scope; letting a property held under a rental tenancy is excluded. Agreements made under the previous act may remain governed by it. Do not apply older cost-based-rent advice to every new private house or cooperative-apartment agreement. Check notice and security of tenure for the applicable contract type, rather than assuming one rule covers all homes. For a rent dispute, promptly check the Rent Tribunal procedure and deadlines relevant to your agreement. This guide predicts no case outcome.

A common question

Does a sublet automatically become a first-hand tenancy?

No. A long stay does not itself create a right to take over the first-hand contract. Any security of tenure is a separate question from transferring the tenancy. For personal planning, record permission and contract end dates and discuss renewal or seek alternatives ahead of time. Do not base financial decisions on a verbal promise of future takeover.
